Buying a House After Divorce

Published 2026-09-09 Last reviewed 2026-09-09 By Lisa C Hamilton, REALTOR®

Quick Answer

You can buy a house after divorce, but the lender needs to understand how the divorce affects existing mortgage liability, property ownership, alimony or support obligations, support income, debt division, sale proceeds, and credit. A divorce decree saying your former spouse will pay a debt does not always automatically make that debt disappear from mortgage underwriting.

Existing Mortgage

If your name remains on the old mortgage, you may still be legally obligated to the lender even if your ex owns the home. That can affect qualification.

Divorce Decree vs. Creditor

Your divorce agreement controls obligations between spouses. It does not necessarily rewrite the original lender contract. The lender's analysis of who remains obligated is what counts for mortgage qualification.

Support Income

Certain documented support income may potentially be used when it satisfies lender requirements for receipt and continuance.

Support Obligations

Required payments can affect DTI.

Sale Proceeds

If marital property is sold, those proceeds may become down payment, reserves, or debt payoff once properly documented. Lenders may need the full paper trail.

Emotional Side

A post-divorce purchase often comes with urgency. Do not let that pressure you into the wrong house. Lisa can help build a new-home search around:

  • Actual budget
  • New lifestyle
  • Location
  • Maintenance
  • Long-term affordability
