Can an HOA Restrict Short-Term Rentals in Nevada?

Published 2026-09-13 Last reviewed 2026-09-13 By Lisa C Hamilton, REALTOR®

Quick Answer

Short-term rental use can be affected by multiple layers of regulation, including HOA governing documents, municipal or county rules, zoning, licensing and other applicable law. Do not buy a property assuming Airbnb income until you verify the specific property can lawfully be used that way.

HOA Approval Is Not Government Approval

Even if an HOA does not prohibit a use, local law may regulate it.

Government Approval Is Not Necessarily HOA Approval

The reverse can also matter.

A short-term rental can be lawful at one level and not at another. You need to check both.

Property-Specific Research

Las Vegas Valley properties may be located in the City of Las Vegas, Henderson, North Las Vegas, or unincorporated Clark County.

Do not use one jurisdiction's rules for every "Las Vegas" address.

Permit, zoning and short-term rental licensing research must use the correct authority for the specific property.

Investor Rule

Do not underwrite a purchase based on projected short-term rental income until legal use is verified.

Verification means the actual HOA documents and the actual municipal or county rules for that address, not a neighbor's experience or a listing remark.

NEVER BUY ASSUMING AIRBNB INCOME. Verify the specific property can lawfully be used that way before you underwrite the purchase on it.
