Las Vegas Buyer Due-Diligence Center HOA & Association

How Do You Read HOA Documents Before Buying?

Published 2026-09-13 Last reviewed 2026-09-13 By Lisa C Hamilton, REALTOR®

Quick Answer

You do not need to memorize every page. Start with the provisions that affect money, your intended use, property modifications, vehicles, rentals, pets, and enforcement.

CC&Rs

Look for restrictions involving property use, leasing, exterior changes, parking, animals, nuisance, and architectural control.

These are the rules that shape how the property can actually be used, not just what it looks like.

Rules and Regulations

Beyond the CC&Rs, many communities maintain rules and regulations that contain practical day-to-day restrictions.

Ask for both sets of documents.

Financial Information

Look for the budget, reserve information, assessments, and major projects.

The association's financial health matters as much as its rules.

Meeting Information

Recent meeting records can provide context about issues receiving association attention.

Minutes can surface disputes, planned projects, and enforcement patterns that a fee sheet alone will not show.

Read for Your Life

Example

Buyer A has two normal cars and no pets.

Buyer B has an RV, three dogs, a home business, and plans to rent in two years.

The same HOA can work perfectly for one and terribly for the other.

Read the documents against your actual life, not the life the marketing material imagines.

Ask Questions Before Closing

Do not rely on "My neighbor said they allow it."

Verify important restrictions in writing through the appropriate association documents and disclosures.

Important

Nevada common-interest-community law establishes resale-document requirements and association disclosures in covered transactions. Verify the current statutory framework and the association's actual documents for the specific property.
